Land Your Bets, L.L.C. Affiliate Agreement

This Affiliate Agreement is made by and between the Company, Land Your Bets, L.L.C. ("Land Your Bets"), and the individual or entity ("Affiliate"), who agrees to the terms of this Agreement by signing below.

Effective Date: The date of the Affiliate's electronic signature below.

Section 1: Purpose of the Program
The Affiliate agrees to promote the Company's Products — recurring subscriptions on landyourbets.com, including but not limited to VIP subscription — and refer new customers to the Company in exchange for a commission, as described below.

Section 2: Affiliate's Role
The Affiliate may promote Land Your Bets primarily through word-of-mouth but is also permitted to advertise, use social media, email lists, and other promotional methods, provided all activities comply with U.S. laws and regulations, as well as the policies and terms of the platforms used. Affiliates must not engage in misleading, false advertising, spamming, or any non-compliant activities.

Section 3: Commission Structure
Type of Payment: Recurring commission for the length of the subscriber.
Commission Amount: The Affiliate will receive the commission rate agreed to and communicated in the Affiliate's welcome kit email, calculated as a percentage of the current subscription price for each qualifying sale. Commission amounts will automatically adjust if subscription pricing changes.
Qualifying Sales: A qualifying sale is defined as a paying subscriber who signs up using the Affiliate's unique referral link and remains subscribed to the Product for the month.
Self-Referrals: Affiliates may not refer themselves or use their own referral link for personal subscriptions. Any such referrals will be disqualified and commissions will not be paid.  

Section 4: Payment Terms
Payment Schedule: Commissions will be paid out via method agreed with affiliate on the 30th of each month, covering all of the Affiliate's earnings from the previous month.
Threshold: There is no minimum payout threshold, and all qualifying commissions will be paid monthly.
Chargebacks and Refunds: If a referred subscriber's payment is refunded, disputed, or charged back for any reason, the corresponding commission will be deducted from the Affiliate's future earnings. If the Affiliate has no future earnings, the Company reserves the right to recover the overpaid commission.

Section 5: Affiliate Obligations
The Affiliate may promote Land Your Bets in any manner, provided the Affiliate complies with U.S. laws and regulations, the policies and terms of the platforms on which the promotions occur, and no misleading advertising, spamming, or false advertising.

Section 6: Duration of the Agreement
Effective Date: This Agreement takes effect immediately upon signing.
Termination: This Agreement may be terminated by either party at any time with written notice. Written notice from the Affiliate should be sent to [email protected].
Post-Termination Commissions: Upon termination, the Affiliate will continue to receive commissions for subscribers referred prior to termination for a period of 6 months following the termination date, provided those subscribers remain active and payments are not refunded or charged back. After this 6-month period, all commission payments will cease.

Section 7: Tracking Referrals
The Affiliate will be provided a unique affiliate link and tracking identifier upon acceptance of this Agreement. If a referred customer uses this link, the referral will be tracked using cookies for 90 days. If the customer signs up within 90 days of clicking the link, the Affiliate will receive the commission.
Attribution: In the event a customer clicks multiple affiliate links, the first affiliate link clicked will receive attribution for the sale.

Section 8: Modifications to the Program
The Company reserves the right to modify the commission rate, payment terms, or other aspects of this Affiliate Program with 30 days written notice to the Affiliate. Continued participation in the program after such notice constitutes acceptance of the modified terms.

Section 9: Dispute Resolution
Any disputes arising under this Agreement shall be resolved through mediation before resorting to any legal action.

Section 10: Miscellaneous Terms
Independent Contractor: The Affiliate is an independent contractor and not an employee of the Company. The Affiliate is responsible for their own taxes and legal compliance.
Liability Limitation: The Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the Affiliate's participation in the program or from any sales through the Affiliate's link.
Confidentiality: The Affiliate agrees to maintain the confidentiality of any proprietary or non-public information provided by the Company, including details about the Affiliate Program, marketing strategies, and customer information.

Section 11: Signatures
By checking agreement terms below, the Affiliate agrees to the terms and conditions of this Agreement.
